The Commission forProtection of Competition initiates proceedings to establish a possible violation under Art. 24, para. 1 of the LPC from "Viva Corporate Bulgaria" EOOD

The Commission for Protection of Competition (CPC, the Commission) has received signals from "Yettel Bulgaria" EAD and "A1 Bulgaria" EAD, in which it is claimed that Mr. Spas D. Rusev personally or through the company "Viva Corporate Bulgaria" EOOD in September 2022 acquired control over Bulsatcom EOOD through a transaction by virtue of which it acquired at least 75% of the capital of Bulsatcom Investment Limited, UK (a company that is the sole owner of the capital of Bulsatcom ). Similar information about the transaction is also contained in numerous media publications (Capital, Mediapool, Dnevnik, etc.).

As a national competition authority and in fulfillment of its statutory powers under Chapter V of the Law on Protection of Competition (LPC), the Commission controls concentrations between undertakings subject to mandatory prior notification in cases where there is a change of control on a lasting basis according to the Art. 22 of the LPC.

In this regard the CPC, with Decision No1070/22.12.2022 initiated proceedings on the basis of Art. 38, para. 1, item 1 of the LPC to establish a possible infringement under Art. 24, para. 1 of the LPC by "Viva Corporate Bulgaria" EOOD for the acquisition of control over Bulsatcom Investment Limited, respectively over "Bulsatcom" EOOD
