CPC imposes sanctions to Multidisciplinary hospital for active treatment “Dr. Bratan Shukerov” AD for abuse of a dominant position

By Decision № 306/21.03.2024 г., the CPC established that Multidisciplinary hospital for active treatment “Dr. Bratan Shukerov” AD has infringed Art.21, par.5 of LPC by abusing its dominant position on the market for the provision of services for “access to equipment, facilities and specialists for performing X-ray scopy and graphy“ to other health care facilities in the city of Smolyan, which may prevent, restrict or distort competition and affect the interests of consumers by unjustified refusal to provide a service to SMOLYANI" - Outpatient Clinic for Specialized Outpatient Medical Care Ltd. (MC "SMOLYANI - ASIMP" Ltd.) in order to prevent its business activities.

The Commission imposed a pecuniary sanction in the amount of BGN 8 380, the amount of which corresponds to the nature and extent of the specific infringement and serves as a deterrent against future anti-competitive actions.

On the basis of article 64, (1) LPC The decision of the Commission may be appealed before Administrative Court – Sofia Region on the grounds of its conformity with the law by the parties to the proceedings or by any third person that has legal interest. within a term of 14 daysof notification in accordance with the procedure laid down in the Code of Administrative Procedure, and for third parties – as of the date of its publication in the electronic register of the Commission.
